GENERAL CONDITION OF SALE

Asiatides.com (hereinafter referred to as “the Website”) is published by the company ASIATIDES Import SAS, identified in the Paris Trade and Companies Register under the number 321817900, with an intra-community VAT number FR0532181790000087 (hereinafter referred to as “ASIATIDES”). All orders placed on the Website are subject to these General Terms and Conditions of Sale. ASIATIDES reserves the right to adapt or modify these at any time, with the version of the General Terms and Conditions of Sale applied to any transaction on the asiatides.com Website at the time of the order.

Ⅰ. Client

The customer declares to be a natural person, at least eighteen (18) years old, and to have legal capacity or to have parental authorization allowing them to place an order on the Website. When registering the customer’s personal data in the “my account” section, the customer must ensure the accuracy and completeness of the mandatory data provided. In the event of an error in the labeling of the recipient’s coordinates, ASIATIDES cannot be held responsible for the impossibility of delivering the product. ASIATIDES reserves the right to cancel any order when the customer’s IP address is domiciled in a country different from the billing and/or delivery address.

Ⅱ. Products

ASIAITIDES sells items that are the result of artisanal production rather than industrial production, which excludes the completely identical character of the pieces that may vary according to production. The products offered for sale are those described on the Website. ASIATIDES takes the utmost care in presenting and describing these products to best satisfy the customer’s information needs in accordance with the provisions of Article L.111-1 of the French Consumer Code (Code de la consommation). However, it is possible that non-substantial errors may appear on the Website, which the customer acknowledges and accepts. In any case, in terms of non-conformity of the product delivered compared to its description on the Website, the customer may either exercise their right of withdrawal or implement the conformity guarantee of ASIATIDES, which will proceed, if necessary, to either exchange or refund (in whole or in part) the price charged.

Ⅲ. Order

Any order implies the reading and acceptance of these terms and conditions of sale in effect on the day of the order. The terms and conditions of sale in effect are those accessible on the Website on the date of the order.

Failure by the Customer to fulfill the obligations under these terms, and in particular incidents of non-payment of the price of an order, may result in the suspension of access to the Website, or even the termination of their Customer Account, depending on the degree of severity of the actions in question, without prejudice to any damages that ASIATIDES may seek. Consequently, ASIATIDES reserves the right to refuse any order from a customer with whom such a dispute exists. The Customer acknowledges the accuracy of the information provided when placing the order, and in the event of an error in the recipient’s contact details, ASIATIDES cannot be held responsible for any inability to deliver the product.

In the event of a disagreement, automatic recording systems are considered as evidence of the nature, content, and effective date of the order.

All orders are strictly for the personal use of the customer.

Ⅳ. Delivery-reception

ASIAITIDES commits to making every effort to execute the order within a period of two (2) to seven (7) working days for delivery. After confirmation of the order and validation of online payment, the package will be delivered to the address chosen by the Client. These delivery times are given for information purposes only, any delays do not entitle the client to cancel the sale, refuse the goods, or claim damages.

The Client acknowledges that, due to computer errors, it is possible that the goods displayed on the Website may be out of stock in reality. In this case, ASIATIDES will contact the Client to offer an exchange, credit note, or refund.

For the delivery, if the client is absent during delivery, a delivery notice will be left by the carrier in the Client’s mailbox. An electronic message may also be sent to the Client’s email or mobile phone. The Client must contact the carrier to arrange a new delivery appointment.

ASIATIDES is released from its delivery obligation for any case of force majeure (total or partial strikes, floods, fires, inability to be supplied, etc.) or unforeseeable circumstances.

Ⅴ. Prices and Payment Methods

1. Price of the products

The prices of the products are indicated in euros with tax included. ASIATIDES reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in effect at the time of the recording of the order, subject to availability.

2. Transport fee

Delivery is free for orders with a total amount of more than three hundred (300) euros. For orders less than three hundred (300) euros, additional shipping fees will be added. For an order of less than three hundred (300) euros intended for a client in the European Union or the United Kingdom, a delivery fee of ten (10) euros will apply. For an order of less than three hundred (300) euros intended for a client in other continents of the world, shipping fees of thirty (30) euros will be added.

3. Customs duty

As soon as ASIATIDES receives payment from the Client, it will provide all the necessary documents to Delivery company so that it can declare the export and import of goods on behalf of ASIATIDES to the customs of the country where the Client resides. The Client acknowledges that, if they are not a resident of the European Union, they will be obliged to pay customs duty to import the goods. This amount will be invoiced by Delivery company before delivery to the Client. ASIATIDES will not be responsible for any delivery delays caused by the Client’s failure to pay the customs duty on time.

4. Payment method

The full payment of the order amount and delivery fees is due upon order placement. The products remain the property of ASIATIDES until full payment is received.

The customer can choose to pay for their order using a credit card, PayPal, or any other payment method available on the Website. If paying by credit card, the amount of the order will be charged upon validation of the order.

Payment for the order must be made in euros. If the customer pays with a different currency, the exchange rate will be set by the customer’s bank and is not the responsibility of ASIATIDES.

The payment process is secured, using high-performance encryption systems and complying with the PCI-DSS security standards.

If the customer’s bank refuses payment authorization, the order will be cancelled.

After payment of the order, the customer will receive an invoice by email. Any claim related to the invoice must be made in writing within thirty (30) days of receipt of the invoice. Otherwise, the invoice will be deemed accepted without reservation.

ASIATIDES reserves the right to refuse any order or delivery in the event of a dispute with the customer, non-payment of a previous order in full or in part by the customer, refusal of credit card payment by banking institutions, or for any other legitimate reason.

VI. Damages during transport and reservations upon delivery

The customer must verify the conformity of the goods upon receipt. In case of loss or physical damage, the customer must immediately report it to the Delivery company service in their local area to obtain proof of damage during delivery. The customer undertakes to send this proof electronically to ASIATIDES before any further request. Otherwise, ASIATIDES reserves the right to refuse the customer’s request for exchange, credit note, or refund.

The customer is required to indicate by email if they wish to proceed with an exchange, credit note, or refund of the product. Without this information, a credit note will be automatically issued, and no claim will be accepted thereafter.

In the event of an error in the delivery of an order, the customer is invited to return the ordered product(s) to ASIATIDES. If the customer has already paid for the delivery, the delivery fee will be refunded by ASIATIDES, which, unless the customer has expressed in writing their desire to cancel the order, will resend the order as soon as possible, provided that the returned products have been received by ASIATIDES in their entirety, in good condition, and in their original packaging.

VII. Right of withdrawal

The customer has a right of withdrawal, which they can exercise without giving any reason, within a period of fourteen (14) days from the delivery of the order (in accordance with Article L221-18 of the Consumer Code). This right may be exercised by returning the unused products (in their original packaging, unused and undamaged) at the customer’s own expense to the following address: ASIATIDES, 16 avenue Victoria, 75001 Paris. ASIATIDES will refund to the customer any sum already paid, less any shipping costs, provided that the products are returned in good condition.

VIII. Exchanges, refunds, and returns

In addition to the right of withdrawal granted by article L121-16 of the Consumer Code, the Client benefits from an additional period of fourteen (14) days during which they can request an exchange, a credit note or a return.

To benefit from this, the Client must, within this period, send the products they wish to exchange, receive a credit note or return at their own expense to ASIATIDES, providing proof of this shipment electronically.

The returned products must never have been used or damaged, and must be delivered in their original packaging, intact and fit for resale. If any of the above conditions are not met, ASIATIDES reserves the right to refuse exchange, credit note or refund.

IX. Responsibility

ASIAIDES cannot be held responsible for the non-performance or improper performance of an order in case of force majeure or external causes. The creations and products offered on the Website comply with the current French legislation. ASIATIDES shall not be liable for any breach of the legislation of the country where the product is delivered. The choice and purchase of a product are solely the responsibility of the Customer. The impossibility to use the purchased product for any reason does not engage ASIATIDES’ liability, without prejudice to the provisions of articles VI and VIII of these terms. ASIATIDES will not be responsible for the malfunction of the Website and/or the software used on the Website or obtained from it; for the loss of data or services resulting from delays, absence of transmission, incorrect transmission, or interruption of services; for the accuracy, quality or nature of the information obtained through these services, nor for the consequences arising from it, or for any damages resulting from viruses transmitted through these servers; costs, loss of profit, or indirect losses resulting from the use of the Website by the customer, or the inability of the customer to access it. In any case, the customer benefits from the legal guarantee of conformity and the guarantee of hidden defects provided for in articles L211-1 to L211-12 of the French Consumer Code (Code de la Consommation) and 1641 to 1649 of the French Civil Code (Code Civil). To benefit from any of these guarantees, it is imperative to present the purchase invoice of the product.

X. Applicable law

Any order automatically implies the customer’s agreement to the General Terms and Conditions of Sale. These general terms and conditions of sale are governed by French law. In case of dispute, only French courts shall have jurisdiction. In case of difficulty or complaint regarding an order, the customer may contact the Customer Service to find an amicable solution.

XI. Information Technology and Liberties

The information collected by ASIATIDES during a customer’s order is necessary for the management of the transaction. It may, for this purpose, be communicated in whole or in part to service providers of ASIATIDES involved in the execution of the order. The customer is informed that the same personal data may also be collected by an organization responsible for analyzing orders and combating credit card fraud. In accordance with the French Law No. 78-17 of January 6, 1978 concerning information technology, files, and liberties (Loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés), the Customer has the right to access, rectify, oppose and delete the data.
